Property Maintenance Reminder--Lawn Maintenance

The Paducah Fire Department’s Fire Prevention Division reminds the public of the City of Paducah’s Code of Ordinances regarding property maintenance, specifically the maintaining of yards.  Deputy Fire Chief of Fire Prevention Greg Cherry says, “Paducah has had quite a bit of rain this spring causing the grass to grow quickly.  We are starting to get calls from citizens who are upset about a neighbor’s lawn.” 

As a reminder, Section 42-50(a)(4) of the Paducah Code of Ordinances states that it shall be unlawful for the owner, occupant, or person having control or management of any land within the city to permit a public nuisance to develop thereon.  The excessive growth of weeds, grass, or other vegetation, except flowers or other ornamental vegetation which are well maintained, is considered to be a public nuisance.  In the ordinance, the term “excessive" means growth of weeds and grass to a height of ten inches or more.

Once the Fire Prevention Division is notified about a property that needs mowing, there are several steps in order to notify the owner and remedy the problem.  The first step is placing a sign in the yard notifying the property owner that he or she has five days to take care of the tall grass.  After the five days passes, the code enforcement officer will make a second inspection.  If the grass has not been taken care of at that time, then a contractor will be hired by the City to mow the property, and the property owner will be levied a $100 fine, abatement costs, and administrative charges.  Plus, a lien will be placed on the property. 

Cherry says “Many times citizens who live in a neighborhood with a yard that is not maintained as outlined in the Code of Ordinances don’t realize that the City is trying through notification and eventually fines to encourage a property owner to take care of the overgrown yard.  We also rely on neighbors to encourage and help each other in maintaining their neighborhoods.”
